Paid Off, Still Reported? A Reddit Guide to a New FCRA Case

A consumer says he paid off his credit card, yet $15.73 in fees appeared and the negative reporting stayed. A federal magistrate judge has recommended that his FCRA claims be allowed to proceed. Here is what that does, and does not, mean.

What the consumer alleges

On November 4, 2026, AccountsRecovery.net reported that a magistrate judge in the U.S. District Court for the District of Delaware recommended that a consumer’s Fair Credit Reporting Act (FCRA) lawsuit against three credit reporting agencies and a credit union move forward. The points below are the consumer’s allegations. The court has not found them to be true.

  • The paid-off card: He says he paid his credit card’s $1,040.15 balance in person at a branch. The credit union then assessed another $15.73 in fees or debits and reported negative information on the account. He disputed it, but the reporting stayed.
  • The “charged-off” accounts: He also had two accounts with a lender that all three credit reports showed as charged off, with balances of $1,592 and $715. He says the lender had sent him letters days earlier stating neither account was charged off.
  • The disputes: He says he disputed with each agency and supplied documentation, but the charge-offs remained.

At this early screening stage, Magistrate Judge Sherry R. Fallon found all three FCRA claims plausibly pleaded and recommended that they proceed. That includes his claim that the credit union failed to investigate or correct the $15.73 balance after the agencies notified it of his dispute. She recommended dismissing his state-law contract and defamation claims as preempted by the FCRA.

Important: This is a recommendation, not a final ruling. It is not a judgment, and it is not a finding that anyone violated the law. It means only that the claims, as alleged, were found sufficient to move past this early stage.

What this means if you’re working on your credit

  • Paying a debt doesn’t automatically erase accurate history. Accurate past negative information, such as earlier late payments, can generally stay on your report even after you pay. A balance that is reported wrongly is a different matter.
  • A small disputed balance isn’t proof of a violation. Whether reporting is inaccurate, and whether anyone failed to investigate reasonably, depends on the facts.
  • Get it in writing. In this case, the judge pointed to the lender’s alleged written confirmation that the accounts were not charged off. Letters like that can be important documentation.
  • Dispute with the credit bureaus and send your documents. Under the FCRA, a bureau that receives a dispute generally must notify the company that furnished the information, and that company must investigate.

Why this case stands out

  • The disputed leftover amount was just $15.73, and the claim over it was still recommended to proceed.
  • The judge relied on the alleged written statements from the lender saying the accounts were not charged off.
  • The consumer is representing himself, without a lawyer.

The takeaway

For anyone in Reddit credit communities trying to sort out a paid account that still looks wrong, the practical lessons are simple: keep your receipts and creditor letters, dispute in writing, and follow up. The case itself is still at an early stage, and no outcome has been decided.
