For readers of Reddit credit communities who have lost an offer after a background check, it helps to know that screening reports are consumer reports under federal law, and errors can be challenged.
Common background check errors
If you applied for a private-sector job and the employer used a screening company, these are some of the errors that can show up:
- A criminal charge that belongs to someone else, often with a similar name.
- A felony shown even though the charge was reduced to a misdemeanor.
- A case that was dismissed, sealed or expunged still appearing.
- A driving record showing a suspended license when your license was valid.
Your rights under the FCRA
- Notice before adverse action. Under 15 U.S.C. § 1681b(b)(3), an employer that plans to take adverse action based on a background report generally must first give you a copy of the report and a summary of your rights.
- Accuracy. Screening companies must follow reasonable procedures to assure maximum possible accuracy (§ 1681e(b)).
- Disputes. You can dispute inaccurate or incomplete information with the screening company, which generally must reinvestigate within 30 days (§ 1681i).
- Your file. You can request a copy of what a screening company has on you (§ 1681g).
These rules have exceptions and details, and government jobs or some state laws may work differently. A dispute doesn’t guarantee a correction or a changed hiring decision.
What to keep
- The background check report.
- The employer’s pre-adverse or adverse action notice.
- Court papers showing the correct outcome of your case.
- Copies of any dispute you send and the response.
The takeaway
Background check problems come up regularly in Reddit credit communities. If a report got your record wrong, the first steps are getting the report, documenting the correct facts and disputing the error with the screening company.
